Terms and Conditions
§1 Scope of Application
(1) These General Terms and Conditions (GTC) apply to all contracts for the rental of devices and products between Cheveo GmbH, operating as Mietwerk Bonn, Friedensplatz 7, 53111 Bonn (hereinafter "Lessor") and the customer (hereinafter "Lessee").
(2) Deviating conditions of the Lessee are not recognized unless the Lessor expressly agrees to their validity in writing.
(3) These GTC apply to both consumers and entrepreneurs within the meaning of the German Civil Code (BGB).
§2 Conclusion of Contract and Booking
(1) The display of rental items on the website does not constitute a legally binding offer, but an invitation to submit an offer.
(2) By submitting a booking request, the Lessee makes a binding offer to conclude a rental contract.
(3) The rental contract is only concluded upon express booking confirmation by the Lessor by email or telephone.
(4) The Lessor reserves the right to reject booking requests without giving reasons.
§3 Minimum Age and Identification
(1) The Lessee must be at least 18 years old.
(2) A valid identity card or passport must be presented upon pickup. The Lessor is entitled to make a copy for documentation purposes.
§4 Rental Period and Handover
(1) The rental period begins with the handover of the rental item to the Lessee and ends with the complete return to the Lessor.
(2) The Lessee is obligated to pick up and return the device at the agreed time. Pickup times are by prior arrangement.
(3) Upon handover, the condition of the rental item will be documented together. The Lessee confirms the proper condition by signature or receipt confirmation.
(4) Late returns will be charged at the respective daily rate per commenced day, but at least 50% of the daily rate for delays of up to 4 hours.
§5 Rental Price and Payment
(1) The rental price is based on the price list valid at the time of booking confirmation. All prices include statutory VAT.
(2) Payment of the rental price and deposit is made upon pickup of the device. Accepted payment methods: cash, EC card, credit card.
(3) For deliveries, payment is due before handover of the rental item.
§6 Deposit
(1) The Lessee deposits a security deposit in the amount specified at booking upon pickup.
(2) The deposit serves to secure the Lessor's claims for damage, loss, late return, or increased cleaning costs.
(3) Upon proper return of the rental item, the deposit will be fully refunded. The refund will be made in the same form as the payment.
(4) The Lessor is entitled to offset legitimate claims against the deposit. If the claims exceed the deposit, the Lessee is obligated to make additional payment.
§7 Delivery and Pickup
(1) Upon request, the Lessor offers a delivery and/or pickup service for an additional fee.
(2) Delivery is made by arrangement within the delivery area. Delivery times are non-binding unless a binding date has been expressly agreed.
(3) The Lessee must ensure that the delivery address is accessible at the agreed time and that a person is present to receive the delivery.
(4) In the event of an unsuccessful delivery due to the Lessee's absence, the delivery costs will be charged again.
§8 Obligations of the Lessee
The Lessee is obligated to:
- Handle the rental item carefully and properly according to the operating instructions
- Use the rental item only for its intended purpose
- Not to pass on or lend the rental item to third parties
- Report damage, defects, or loss to the Lessor immediately
- Not to make any repairs or modifications to the rental item
- Return the device in a cleaned condition
- Return the supplied consumables and accessories completely
§9 Cleaning and Condition Upon Return
(1) The Lessee is obligated to return the device in a clean, ready-to-use condition. Gross contamination must be removed.
(2) If returned in a heavily soiled condition, a cleaning fee of at least €25.00 will be charged. The exact amount depends on the cleaning effort required.
(3) Water tanks and dirty water containers must be returned emptied and rinsed.
§10 Liability of the Lessee
(1) The Lessee is liable for all damage to the rental item that occurs during the rental period, unless they can prove that they are not responsible for the damage.
(2) In the event of loss, theft, or total damage, the Lessee is liable for the replacement value of the rental item (new price).
(3) The Lessee is also liable for damage caused by improper use, misuse, or failure to follow the operating instructions.
(4) In the event of theft, the Lessee is obligated to immediately file a report with the police and provide the Lessor with a copy of the report.
§11 Liability of the Lessor
(1) The Lessor is liable without limitation for damages resulting from injury to life, body, or health, as well as for damages based on intent or gross negligence.
(2) In the case of slight negligence, the Lessor is only liable for breach of essential contractual obligations and only for foreseeable, contract-typical damages.
(3) The Lessor is not liable for consequential damages, lost profits, or damages from loss of use, to the extent permitted by law.
(4) The Lessor assumes no liability for damages caused by improper use of the rental item by the Lessee.
§12 Cancellation and Withdrawal
(1) Free cancellation by the Lessee is possible up to 24 hours before the agreed pickup time.
(2) In case of cancellation less than 24 hours before the pickup time or non-pickup, a cancellation fee of 50% of the rental price will be charged.
(3) The Lessor reserves the right to withdraw from the contract for important reasons (e.g., device defect, force majeure). In this case, rental fees already paid will be fully refunded. Further claims by the Lessee are excluded.
§13 Force Majeure
In the event of force majeure (e.g., natural disasters, pandemics, official orders), both parties are released from their performance obligations as long as and to the extent that performance becomes impossible or unreasonable due to the event. Amounts already paid will be refunded proportionately.
§14 Right of Withdrawal for Consumers
(1) Consumers generally have a 14-day right of withdrawal for distance contracts.
(2) The right of withdrawal expires prematurely if the Lessor has fully provided the service (provision of the rental item) and the Lessee has expressly agreed before the start of provision that the Lessor should begin providing the service before the expiry of the withdrawal period, and the Lessee has confirmed their knowledge that by giving consent they lose their right of withdrawal upon commencement of performance.

§16 Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) If the Lessee is a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Bonn.
(3) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be deemed to be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
(4) Amendments and supplements to this contract must be in writing. This also applies to the waiver of the written form requirement.
